This website is operated by Fifty Two Hundred Photo, LLC. Throughout the site, the terms “we,” “us,” and “our” refer to Fifty Two Hundred Photo, LLC. Fifty Two Hundred Photo offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. The terms “user,” “you,” and “your” refer to site visitors, customers, and any other users of the site.

By accessing our site and/or booking a session with us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms”), including those additional terms and conditions and policies referenced here and/or available by hyperlink. These Terms apply to all users of the site, including but not limited to browsers, vendors, clients, and contributors of content.

Use of www.fiftytwohundredphoto.com, including all materials presented and all services provided by Fifty Two Hundred Photo, LLC is subject to the following Terms and Conditions. Please read them carefully. By accessing or using any part of the site or services, you agree to these Terms. If you do not agree, please do not access the site or use our services.

Any new offerings or features added to the site shall also be subject to the Terms. We reserve the right to update or modify these Terms at any time, and it is your responsibility to check this page periodically for updates. Continued use of the site or services after any changes constitutes acceptance of those changes.

2. Booking & Refund Policy

By booking a session or purchasing services from this website, you represent that you are at least the age of majority in your jurisdiction, or have given us permission to work with your minor dependents.

All photography session retainers are non-refundable. In the case of rescheduling due to illness, inclement weather, or emergencies, we offer flexible date changes within six (6) months of the original session date, based on availability.

Due to the custom and creative nature of photography, all sales are final and no refunds are given after services are rendered or digital files are delivered. If you are unsatisfied with your experience, please reach out to katrina@fiftytwohundredphoto.com so we can discuss your concerns.

If you opt for a payment plan, you authorize Fifty Two Hundred Photo to charge your card based on the agreed terms at the time of booking. You agree not to dispute charges and understand you may be responsible for collection and legal fees if your account goes into default.

3. General Conditions

We reserve the right to refuse service to anyone at any time for any reason.

While we protect your privacy, you understand that your information (not including credit card details) may be transmitted over various networks and may be adapted to meet technical requirements. Credit card information is always encrypted during transfer.

You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the site or services without written permission from us.

The information on this site is for general guidance and inspiration only and may not always be current or complete. You agree to use your own judgment before relying on any content on the site.

The artistic and emotional tone of each session is at the discretion of the photographer, and we make every effort to align our vision with your wishes as discussed during planning.

4. Account Creation

You may be asked to provide personal information when booking or interacting with the site. You agree to provide accurate, current, and complete information, and to update it as needed. You must not use a false identity or impersonate anyone else.

Any violation of these Terms may result in removal of your access to the site and services.

5. Lawful Use

You may use this site only for lawful purposes. You may not upload or share anything offensive, harmful, threatening, libelous, or otherwise objectionable. We reserve the right to remove any such content and terminate your access.

If you believe your copyright has been infringed upon through our site, please contact us with a written notice including the relevant details and a good faith belief that the use is not authorized.

6. Session Confirmation

You will receive an email confirmation after booking a session or service. If any details are incorrect or missing, it is your responsibility to contact us at katrina@fiftytwohundredphoto.com to correct the information.

7. Image Use & Delivery

Images are typically delivered within 3–4 weeks unless otherwise stated in your contract. You may use your images for personal use and sharing, but not for commercial or editorial purposes unless expressly permitted.

Fifty Two Hundred Photo retains the copyright to all images and may use them for promotional purposes unless otherwise agreed in writing.

You may not alter the images with filters or cropping that removes branding or alters the photographer’s work without permission.

8. Privacy

Your submission of personal information is governed by our Privacy Policy. We never sell or share your personal information.

9. Intellectual Property

This site and its content (photographs, videos, text, logo, branding) are the sole property of Fifty Two Hundred Photo and may not be copied, reproduced, sold, or redistributed without our written consent.

You agree not to share access to any client-only galleries, digital downloads, or products with third parties unless permission is granted.

10. Changes to Services or Pricing

We reserve the right to adjust pricing, session offerings, and available services at any time. You will be notified of changes affecting your booked services, but not retroactively for prior sessions.

11. Limitation of Liability

FIFTY TWO HUNDRED PHOTO, LLC IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING FROM YOUR USE OF THIS WEBSITE OR OUR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU.

12. Indemnification

You agree to indemnify and hold harmless Fifty Two Hundred Photo from any claim or demand, including legal fees, made by any third party due to your breach of these Terms, or your violation of any law or third-party rights.

13. Governing Law & Disputes

These Terms shall be governed by the laws of the State of North Carolina. Any disputes shall be handled in Durham County, NC, and both parties agree to attempt resolution through mediation before pursuing other legal remedies.
